What About Emergencies?

State law 14-271-109 (b)(1-3) provides an exception to the 2 working days notice in emergency cases. An emergency must meet one of the 2 qualifications listed below:

  • The work is necessary for the repair or restoration of service or
  • The work is required to eliminate the immediate danger to life, health, property or public safety.

None of us can achieve safety by ourselves. Safety is achieved when each of us does our part. Arkansas’ damage prevention program is built on a concept of partnership — communication, cooperation, and coordination among the one-call center, utilities, facility locators, and excavators. Your cooperation is essential to your safety.

If you call in an emergency, please make sure that it is really an emergency. On an emergency call, they are required to pull off of a job, rush to an "emergency", and mark the site.

Utility locators have two frustrations with emergency requests:

  • One is when they drive by later, and notice that the work did not start for four or five days. Although, under state law, the work could be classified as an emergency, the caller is not treating it as an emergency.
  • Secondly, work has not been planned in advance and when the utility locator arrives on site he/she finds that an installation of new service has been called in as an emergency repair. This type of request is in violation of state law and could carry a fine, if a utility chooses to pursue the issue.

But mainly, the utility locators worry that because of these types of pull offs, they cannot be as responsive to other requests as they would like to be; and more importantly, they may not be able to respond to another emergency request that does require immediate attention.
